Facility Victim Program
The Facility Victim Program offers legal assistance to residents of nursing
homes, assisted living facilities, and to those who receive care from any
provider of in-home nursing services, adult day care, adult foster care, and
community based waiver programs.We provide the following services:
- Advocacy and advice to those who have been abused, neglected or exploited by a
facility or care provider
- Assistance to clients in filing claims, disputes and appeals
- Education and training to the community on facility victim issues
- Legal assistance in the following areas:
- Quality of care
- Medicaid and Medicare benefits
- Fair Hearing representation on medical necessity, improper discharge and
transfer, and reduction or denial of benefits
- Discharge planning
- Care planning
- Legal guardianship issues, advance directives, medical powers of attorney, and
durable powers of attorney
