Overview

We'll begin by discussing the many types of military discharge categorizations, historical categorization data, legal authority, and the socioeconomic implications of receiving a less than honorable discharge. We'll then explore the differences between the discharge review and correction boards — the governing bodies veterans and their lawyers must petition to — and how we as attorneys can best navigate those structures.   Finally, we'll share a step-by-step guide to working with veterans to successfully prepare a thorough application for a discharge upgrade and/or correction of military records.

What You'll Learn

After completing this CLE, expect to have an understanding of the financial, economic, and social impact of a less than honorable discharge characterization. You will understand the process, legal standards, and administrative boards that evaluate and render decisions on discharge upgrade applications. You'll learn the devastating effects of post-traumatic stress syndrome, how PTSD impedes access to benefits, and how attorneys can best communicate with those afflicted.    But most importantly, this CLE is a first step in a journey you may choose to pursue: Donating your legal talents and time to serving our friends and neighbors who served our country.

About the Host

Tim Gasaway manages Texas Legal Services Center's veteran's legal assistance program. The program works with Texas veterans and their families to assist with common civil (non-criminal) legal concerns that many veterans face—including benefits, military discharge matters, and other legal issues relating to the transition to civilian life.

Tim studied law at Texas Tech University. A veteran himself, he enlisted in the Army in 1988 where he conducted communications support for the Multiple Launch Rocket System (MLRS) Battalion.

Afterward, he practiced mass tort and insurance defense litigation at MehaffyWeber PC, Rice & Pickering, and the McConn Law Firm. Tim accepted a position with Texas Legal Services Center because it provided the opportunity to focus his work on helping veterans resolve their legal problems.
